Under the Americans with Disabilities Act (ADA), employers have legal obligations when handling reasonable accommodation requests from qualified individuals with disabilities. These requirements are designed to ensure fairness, confidentiality, and compliance while supporting employees' ability to perform their jobs. Below is an overview of these requirements:
- Recognize the Accommodation Request
- Engage in the Interactive Process
- Request Reasonable Medical Documentation (if needed). This must be handled according to HIPAA privacy standards.
- Evaluate and Determine an Effective Accommodation
- Provide Accommodation in a Timely Manner
- Document the Process and Outcome. This is a primary responsibility for an HR Generalist.
- Maintain Confidentiality
- Monitor and Adjust the Accommodation as Needed
- Avoid Retaliation or Discrimination
